Abstract

Islamic historical sources record numerous cases of homicide in Andalusia, presenting diverse causes for these crimes. In some instances, the severity of the punishment—capital punishment—was arguably unnecessary, as lesser punishments like imprisonment could have sufficed given the nature of the offense. Occasionally, however, these punishments did align with the severity of the crime. It was noted that in many cases, such penalties were issued by rulers wielding state authority rather than by religious scholars or judges. Conversely, certain punishments were dispensed by esteemed judges known for their fair application of religious laws, promoting societal stability, security, and justice. Furthermore, many punishments stemmed from insubordination to the ruler, conspiracies against state authority, affiliations with rebellious factions, or adherence to beliefs or doctrines opposing the ruling authority.
